Privacy Policy

INSAIM ("INSAIM", "we", "us", or "our") is committed to protecting the privacy of visitors to insaim.design (the "Site").

1. Data Controller

The data controller responsible for your personal data is:

2. Personal Data We Collect

Data provided directly by you. When you complete our contact form, schedule a call, subscribe to updates, or contact us by email, we collect your name, email address, company name (where provided), and any information contained within your message or project brief.

Booking data. Where you schedule a call through Cal.com, we collect your name, email address, and selected appointment time.

Newsletter data. Where you subscribe to updates, we collect your email address. Such addresses are stored within our Webflow form submissions and Notion.

Technical and usage data. When you access the Site, we automatically collect your IP address, browser and device type, referring pages, and pages viewed, by means of analytics tools and cookies, as described in Section 4.

3. Purposes of Processing and Legal Bases

We process personal data for the following purposes and on the following legal bases under the GDPR:

  • To respond to enquiries and prepare proposals — for the purpose of taking steps at your request prior to entering into a contract (Article 6(1)(b)).
  • To operate, secure, and improve the Site by means of analytics — on the basis of your consent in respect of non-essential cookies (Article 6(1)(a)), and our legitimate interest in understanding how the Site is used (Article 6(1)(f)).
  • To process newsletter subscriptions — on the basis of your consent (Article 6(1)(a)), which may be withdrawn at any time.
  • To comply with legal, tax, and accounting obligations — on the basis of a legal obligation to which we are subject (Article 6(1)(c)).

4. Cookies and Analytics

Strictly necessary cookies are required for the operation of the Site and are active at all times. Analytics cookies are set only following your consent, provided through our cookie banner. You may withdraw or amend your consent at any time by means of the cookie settings link located in the Site footer.

We use the following analytics tools:

  1. Google Analytics 4 (Google Ireland Ltd.) — for the measurement of Site usage. Google may process data on servers located outside the European Economic Area, including in the United States; such transfers are safeguarded by the EU Standard Contractual Clauses and by Google's participation in the EU–U.S. Data Privacy Framework.
  2. Webflow Analytics (Webflow, Inc.) — privacy-oriented usage statistics provided by our website platform.
  3. Yandex Metrica (operated by Yandex) — for Site usage and behavioural analytics. Data collected by means of Yandex Metrica is processed on servers located in the Russian Federation, which is not the subject of an EU adequacy decision. Where such a transfer occurs, we rely upon the Standard Contractual Clauses as a safeguard. This tool is set only with your consent and may be refused through our cookie banner.

5. Disclosure of Personal Data

We do not sell personal data. We disclose it only to service providers ("processors") engaged to operate the Site and support our business operations, namely:

Website hosting and form handling — Webflow (Webflow, Inc.); email hosting — (Beget); appointment scheduling — Cal.com; lead and project management — Notion (Notion Labs, Inc.); analytics providers, as set out above; and professional advisers, including accountants, where necessary.

Where any provider processes personal data outside the European Economic Area, we rely upon appropriate safeguards, including the EU Standard Contractual Clauses.

6. Data Retention

We retain enquiry, booking, and lead data for as long as is necessary to respond to you and to manage our relationship, and thereafter only to the extent required by law, including for accounting purposes. Newsletter addresses are retained until you request their removal. Analytics data is retained in accordance with each provider's settings.

7. Your Rights

Under the GDPR, you have the right to access, rectify, erase, restrict, or object to the processing of your personal data, the right to data portability, and the right to withdraw consent at any time. To exercise any of these rights, please contact us at hello@insaim.design.

You further have the right to lodge a complaint with the Portuguese supervisory authority, the Comissão Nacional de Proteção de Dados (CNPD).

8. Information for Visitors in the United States

We do not sell personal data, nor do we share it for the purposes of cross-context behavioural advertising. If you are a resident of the United States, you may contact us at hello@insaim.design to request access to, or deletion of, the personal data we hold concerning you, and we will honour such requests where required by applicable law. We do not knowingly collect personal data from children.

We may amend this Privacy Policy from time to time. The "Last updated" date set out above indicates the most recent revision.

Terms and Conditions

These Terms and Conditions (the "Terms") govern your access to and use of insaim.design (the "Site"), operated by INSAIM ("we", "us", or "our"). By accessing or using the Site, you agree to be bound by these Terms.

1. Use of the Site

You may use the Site for lawful purposes only. You agree not to use the Site in any manner that breaches applicable law, infringes the rights of INSAIM or any third party, or impairs the operation, integrity, or security of the Site.

2. Intellectual Property

All content appearing on the Site — including text, case studies, designs, graphics, layouts, logos, and code — is owned by INSAIM or used under licence, and is protected by applicable intellectual property laws. Client work presented within our portfolio is displayed for illustrative purposes; all rights in such client projects remain with the respective clients. You may not copy, reproduce, republish, or distribute any content from the Site without our prior written consent.

3. Nature of Content; No Professional Advice

The Site is provided for general informational purposes concerning our studio and services. Its content does not constitute a binding offer, professional advice, or any guarantee of outcome. Any engagement for design or related services shall be governed by a separate written agreement, including a proposal, statement of work, or contract, which shall prevail over these Terms in the event of any conflict.

4. Third-Party Links

The Site may contain links to third-party websites. We assume no responsibility for the content, policies, or practices of such websites, which are provided for convenience only.

5. Disclaimer of Warranties

The Site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we make no warranties, whether express or implied, as to the availability, accuracy, or fitness for a particular purpose of the Site.

6. Limitation of Liability

To the fullest extent permitted by law, INSAIM shall not be liable for any indirect, incidental, or consequential loss or damage arising from your use of, or inability to use, the Site. Nothing in these Terms shall exclude or limit any liability that may not be excluded or limited under applicable law.

7. Privacy

Your use of the Site is also governed by our Privacy Policy, which describes how we process personal data.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Portugal. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Lisbon, Portugal.

9. Amendments

We may amend these Terms from time to time. Your continued use of the Site following any such amendment constitutes acceptance of the revised Terms.

This Cookie Policy explains how INSAIM ("we", "us", or "our") uses cookies and similar technologies on insaim.design (the "Site"). It should be read in conjunction with our Privacy Policy, which describes our processing of personal data more generally.
